In California, being charged with codes 11357 a & b will be treated similar to Traffic Violations, where (if you are found guilty) you will not be arrested but ticketed, given a fine.

Plain and simple you can't be arrested if you possess less than an ounce. Either SDSU police or the UT is lying. The end.

It was not slander.

Now consider this, Cop who is by himself stops at the car, Cop sees and smells dope smoke, Cop has no idea who is in the car, Cop has no idea of how much dope is in there (Possibly more than 1 Oz), Cop must handle this deal by himself so he has to temporarily cuff young Mr. Shepard so he can determine what and who much, Cop discovers less than 1 Oz and releases Mr Shepard. While Mr Shepard was cuffed, he was technically under arrest.

what a load of crap. He was cited. It is not a technical arrest.

In order there for there to be an arrest someone has to be detained and either be cuff and/or not allowed to leave.

I do not see wheree the criteria for an arrest is here.

He wasn't arrested. He was detained and cited for poss of mj. Its like when you get a speeding ticket. You arent arrested when a police officer gives you a speeding ticket. He pulls you over, detains you for personal info, and then he cites you. geez.. Plus a speeding ticket under cal penal code is seen as being more serious. Just look at the price difference between both citations.

Richie Williams got a DUI in 07 and Jerome Habel was arrested for spitting on his ex (he was ultimately kicked off the team). Chris Lamb might have gotten a DUI or maybe it was another tall white kid that got one around 2003 or 2004.

This thread is starting to read like a Bar essay.

It seems to me that "technical arrest" is a term of art. I've certainly never heard it before and if "technically arrested" simply entails being "detained" or "not free to leave" then we are all "technically arrested" when we are pulled over for a traffic violation (if the test is based on subjective belief). WS was almost undoubtedly "detained" and probably handcuffed while the officer searched the car, which he could do because he has probable cause to find additional evidence of the crime of possession. If that is a "technical arrest" then WS was "arrested," technically.

The charge is an infraction. It has no custody time behind the infraction unless he fails to appear in court for the citation. He was never arrested. He was detained and cited for possession of marijuana. Worst case scenario he will have to pay a fine and told not to do it again! It kind of like being given a citation for possession of alcohol at the beach...

Maybe a preseason game at the most. Unless the NCAA decides to drug test him tomorrow. The SEC always has players pop dirty for pot and they never suspend their players. Plus it has to be less since Jamal was suspended for 5 games and his charges were misdemeanor.

Let's all remember this article was written by B.S. and this is exactly what was said: A campus police officer checked the parked vehicle he was occupying about 11 p.m. Monday and found a small amount of marijuana, police records show.

When I read that, it first makes me wonder if it was even his car? Also, it seems possible that someone else could have been in the car with him. I am not saying he is free and clear, but what if he was in the car with someone else and they found pot on the other person? In short, we got some information from the B.S. article, but there are clearly some remaining questions to be answered.

Not the end of the world. Maybe a three game suspension. Hopefully he stays out of trouble from here on out
